　　2007年7月15日下午，一名男乘客被夹在地铁屏蔽门和列车之间身亡，死者母亲将地铁运营方及屏蔽门 厂家告上法庭，索赔百万元。日前，徐汇区人民法院作出一审判决，上海地铁运营有限公司赔偿死者家属死亡赔偿 金及精神抚慰金共计50万余元，上海申通地铁承担连带责任。

　　地铁方：

　　死者强行登车造成事故

　　原告曲老太称，2007年7月15日，儿子孙某在轨交1号线上海体育馆站上车时被夹在屏蔽门和车厢门之 间，列车启动后，被搓碾致死。

　　据了解，上海申通地铁是地铁1号线设施所有人。在曲老太看来，地铁方面在运营线路时未尽安全保障义务， 而被告广州广日和西屋公司设计生产安装的屏蔽门存在安全隐患导致事故发生，需要为此承担连带责 任。

　　申通地铁辩称，其与地铁运营是资产方和运营方关系，运营事项由地铁运营独立负责，因此不同意原告的诉讼 请求。地铁运营辩称，地铁设施符合相关标准,prada sunglasses，其已尽到安全保障义务，孙某不文明乘车，强行登车造成伤亡事故，存在重大过错。广州广日辩称，其是涉案地 铁屏蔽门设施的安装施工方,Herve Leger Sale。原告未能举证证明产品存在重大缺陷，故不同意原告的诉讼请求。

　　法院判决：

　　申通地铁承担连带责任

　　法院认为，地铁屏蔽门与列车车厢间的缝隙形成了危害旅客生命安全的产品质量瑕疵,louis vuitton。而地铁运营方警示讯号不合理，疏于对驾驶员和站务员的应急能力培养，应对孙某死亡承担责任。同时，其又未 能证明由于孙某强行登车造成伤亡，故其要求依照过错原则依法处理的抗辩不予采纳。被告申通地铁则应承担连带 责任。

　　此外，考虑到屏蔽门是根据地铁运营的要求生产、安装，因此被告屏蔽门生产厂家广州广日和西屋公司可以不 承担侵权的赔偿责任。

　　据此，法院作出上述判决。
