女子离婚欲让女儿改姓遭拒状告派出所 13681713577

　　原告方认为 ，派出所没有告知纪女士需要书面申请，只是口头答复不能办理,手机监听卡。派出所方面认为，服务大厅里都公示了办理姓名变更所需要的材料，到派出所去办事的市民，都应该视为已经看 过了这些公示,手机监听器价格。只有纪女士先向派出所提出书面申请，派出所才能受理。
　　“去年的时候，纪女士曾经与前夫电话取得过联系，但前夫对女儿改姓这件事的态度是不管不问，也不配合纪 女士到公安机关给女儿改姓 。纪女士的前夫是沂水人，现在完全联系不上，甚至他老家也说找不到他。”原告代理律师最后陈述说，法律没有 明确规定离婚后父亲或母亲一方申请给孩子改姓不能办理，王茜茜现在跟随妈妈生活，考虑到有利于未成年子女的 成长，应当尊重与未成年子女共同生活的一方的意见。随后，法官宣布休庭，案件将择日再审。






　　案件的原告是一名叫王茜茜的5岁小女孩，当天原告的代理律师出庭。王茜茜家住城阳区，1岁的时候，她的 爸爸妈妈协议离婚了，约定茜茜由母亲纪女士抚养，而其父亲离开了青岛。茜茜的代理律师说，王茜茜出生之后是 随父亲姓的，茜茜跟随母亲生活，母亲就想让茜茜改姓纪。纪女士多次到派出所去申请改姓，但都被拒绝了。因此 ，她认为派出所行政不作为，起诉至法院，要求派出所为茜茜办理姓氏变更。茜茜的代理律师说，纪女士去的时候 都是口头申请,手机监听器卡，并没有提供书面申请。
　　正阳路派出所的两名民警作为代理人参加了庭审。“我们并没有收到纪女士的书面申请，她都没有申请，不存 在我所不予受理的问题。而且，根据相关法规，父母离异后，子女要变更姓名的，需要两方共同协商达成一致后才 可以办理。纪女士想给女儿改姓 ，但是没有征得女儿生父的同意，因此并不符合申请条件，我们不予办理完全是依法办事。”民警称 。
